Privacy policy

This policy explains how Happy Cacti ("we", "us") collects and uses personal information when you visit happycacti.com, including Happy Sher, shop with us, or use our birthday reminders. We are the controller of your personal information under UK data protection law (UK GDPR and the Data Protection Act 2018).

What we collect

  • Orders: your name, email address, delivery and billing address, phone number if you give it, what you bought, and payment confirmation. We never see your full card details. Payments are handled by Shopify and its payment providers.
  • Newsletter: your email address, and your name if you give it, when you sign up for emails or our welcome discount.
  • Birthday reminders: your email address, plus the first names, birthdays (day and month only, never the year) and, optionally, your relationship to the people you add.
  • Browsing: with your consent, which pages and products you view and what's in your basket. See "Cookies" below.
  • Messages: anything you send us by email or social media.

How we use it and why we're allowed to

  • To take, make and deliver your order and handle any problems. We need this to carry out our contract with you.
  • To send order and delivery emails. Also needed for our contract with you.
  • To send marketing emails about new cards and offers, only if you've signed up. This is based on your consent, which you can withdraw at any time using the unsubscribe link in every email.
  • To send birthday reminders 10 and 5 days before each birthday you've added. This is based on your consent, which you give when you confirm by email, and you can stop it from any reminder email.
  • To send basket and browsing reminders, if you've accepted marketing cookies and given us your email. This is based on your consent.
  • To keep our records and meet legal duties, such as tax and accounting. This is a legal obligation.
  • To keep the website working and secure and fix problems. This is in our legitimate interests.

Birthday reminders and other people's details

When you add someone to your birthday reminders, you're sharing their first name and birthday with us. We use these only to send reminders to you. We never contact the people you add, and we never share their details for marketing. Please only add people you'd reasonably expect not to mind. You can edit or delete anyone from the link in any reminder email. Choosing "stop all reminders" permanently deletes your list.

Who we share it with

We don't sell your information. We share it only with companies that help us run the shop, who may only use it on our instructions:

  • Shopify: our online shop, checkout and payments.
  • Brevo: our email service, for order emails, newsletters and birthday reminders.
  • Netlify: hosts our website and stores birthday reminder lists.
  • Royal Mail and its international partners, to deliver your order.

Some of these companies may process data outside the UK. Where they do, they use legal safeguards approved under UK law, such as the UK International Data Transfer Agreement or adequacy regulations. We may also share information if the law requires it.

Cookies

We use strictly necessary cookies to keep your basket and make checkout work. These don't need your consent.

With your consent, we also use Brevo's marketing cookies to understand what you browse, so our emails are more relevant and we can remind you about a basket you left. You choose when you first visit, and you can change your mind any time using "Cookie settings" at the bottom of every page.

How long we keep it

  • Order records: 6 years, for tax and accounting.
  • Newsletter and marketing data: until you unsubscribe, then only what we need to keep you unsubscribed.
  • Birthday reminder lists: until you stop your reminders, at which point the list is deleted. Lists that are never confirmed by email are not used to send reminders.

Your rights

You have the right to ask for a copy of your information, to correct it, to have it deleted, to restrict or object to how we use it, and to receive it in a portable format. Where we rely on your consent, you can withdraw it at any time. To do any of this, email info@happycacti.com. We'll reply within one month.

If you're unhappy with how we've handled your information, you can complain to the Information Commissioner's Office (ICO) at ico.org.uk or on 0303 123 1113. We'd appreciate the chance to sort it out first.

Children

Our shop isn't aimed at children under 13, and we don't knowingly collect their information.

Changes

We'll post any changes to this policy on this page and update the date below.
